If you get shoved doesn't that/can't that be considered ault?

From a police perspective, it is impossible to determine who started the type of idiotic fight that you are describing, so the police arrest both parties. From a prosecutor's perspective, if someone is hurt, then the other party is charged with ault. If both people are hurt, then both are charged with ault.
